As you can see, the Rules consider two options for calculating the payment for gas, after a meter malfunction has been discovered (violation of the integrity of the seal):

  • the first implies that the subscriber himself found the fault and reported it to the gas companies.
  • the second is that the gas companies found out about the malfunction themselves during regular or unscheduled inspections.

In the first case, between the reporting of the meter’s malfunction and the moment of its replacement (i.e. sealing), the payment for gas is calculated based on the gas consumption standards in force in the region.

In the second case, the consumer is also transferred to the payment according to the standard until the seal is installed on the new meter, but in addition to this, the gas workers recount the subscriber according to the standard fee for the previous six months. It should be understood that the standards for gas consumption for heating are greatly overestimated. In this case, the consumer is billed an amount that is several times higher than his regular payments on the counter.

Of course, this situation does not look quite fair for the consumer. Without having the necessary skills (and often even without being officially notified), he is appointed by the current legislation responsible for the good condition of his gas meter.

The gas supplying organization, which has specialists and the necessary technologies to monitor the correct operation of the meter, does not bear any risks. Moreover, it definitely benefits (by imposing an overpayment for gas), finding a meter malfunction during the test.

However, these are the requirements of current legislation. Whether they are fair or not is a separate issue, but they must be carried out. That is, you need to follow the counter.

However, even if you notice a faulty state of the metering device and have called the gas industry workers themselves to correct the situation, there is a risk that you will be billed for gas according to the standard for the last six months.

Consider a typical example that took place a couple of years ago in the Orenburg region. The circumstances of the case became known from the materials of the subsequent trial.

A resident of the Orenburg region, A. Kuznetsova, discovered a malfunction of a gas meter installed on the street (the metering device made loud clicks). I reported this on the emergency telephone number of gas services - number "04". After some time, again called back to the same number. As a result, the controller arrived, who drafted a gas meter malfunction report, in which the adult son of a woman who was at that time in the house signed.

However, after some time, Kuznetsova received a bill from the local gas supplying organization to pay for gas consumption according to the standard for the previous six months. The requirement was motivated by the second paragraph of paragraph 28 of the “Rules for the supply of gas for the provision of household needs of citizens”. Thus, where it comes to the case of detection of a meter malfunction by the gas producers themselves during the inspection.

A resident of the Orenburg region disagreed with such a blatant violation of her rights and filed a lawsuit in a local court. The case was won by her both in the first and in the second instances, where the gas workers appealed.

The position of the gas supplying organization, as it turned out during the consideration of the case, was reduced to the fact that they said that Kuznetsova had not made the call — the number “04” did not belong to the gas supplier of Gazprom Mezhregiongaz Orenburg. Accordingly, the company does not have information about this call and its content. The gas workers checked the meter as part of the regular inspection, which is recorded in the company's internal documents. The fact that the inspector came to the house and checked the gas equipment shortly after the call to the number “04”, according to the gas companies, is just a coincidence.

These arguments the court found not convincing.

Having received the decryption of calls from the Kuznetsova A. A. phone from the operator, the court established that the woman actually called the number “04” on the indicated days. It was also established that this number is actually served by another organization - OAO Gazprom Gas Distribution Orenburg, which deals with the maintenance of gas equipment, but does not supply gas to the population. It turned out that an employee of this organization, who had received a call from 04 to Kuznetsova, did not inform her of the need to contact the gas supplier directly.

Thus, the court established that Kuznetsova had fulfilled her obligations to notify about the malfunction of the gas meter. And it is not her fault that the gas workers among themselves cannot organize the exchange of information.

Based on this conclusion, the court determined that in the considered case it is necessary to apply the first paragraph of paragraph 28 of the Rules. Those. that option, when the subscriber himself notified the gas industry workers of the malfunction and, accordingly, must pay for the gas according to the norm during the period from the day of the discovery of the malfunction to the day of replacement of the meter (installing a seal on it).

By the time the decision was made, Kuznetsova managed to pay the amount billed to her (so that later she would not pay any penalties for it). This money was credited by the court in the account of the future payment for gas.

As the analysis of judicial practice shows, it is far from always that cases of unfair gas meters are completed in favor of the consumer. In many cases, they fail to prove the fact of appeal. And it is clear how this happens.

Suppose the owner of the house is alerted by something in the work of the counter. He called the gas producers one time, another ... No one came. Leak like no. The device does not take into account excess consumption. Rather the opposite. Well, okay, so be it ...

And then the inspector arrives, switches on the comfort on the gas stove, and detects that the meter is not responding. After that, a statement of failure of the metering device is drawn up and a receipt comes with recalculation for the last six months according to specifications.
